CEDAW 1979 (Convention on the Elimination of All Forms of Discrimination against Women), Article 1, defines 'discrimination against women' as:

1. Article 1 CEDAW: 'For the purposes of the present Convention, the term 'discrimination against women' shall mean any distinction, exclusion or restriction made on the basis of sex which has the effect or purpose of impairing or nullifying the recognition, enjoyment or exercise by women, irrespective of their marital status, on a basis of equality of men and women, of human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field.' 2. CEDAW covers ALL forms of discrimination — direct and indirect, formal and substantive. 3. Article 4 permits TEMPORARY SPECIAL MEASURES (affirmative action) to accelerate de facto equality. 4. India ratified CEDAW on 9 July 1993. 5. India's Vishaka v State of Rajasthan, AIR 1997 SC 3011 used CEDAW directly. 6.
