Consider the following statements: 1. If the election of the President of India is declared void by the Supreme Court of India, all acts done by him/her in the performance of duties of his/her office of President before the date of decision become invalid. 2. Election for the post of the President of India can be postponed on the ground that some Legislative Assemblies have been dissolved and elections are yet to take place. 3. When a Bill is presented to the President of India, the Constitution prescribes time limits within which he/she has to declare his/her assent. How many of the above statements are correct?

AOnly one
BOnly two
CAll three
DNone
Answer & Solution
Correct answer: D. None
Answer: D. NONE of the three statements is correct. (1) Acts done by President become invalid if his/her election is declared void: WRONG. Article 71(2) of the Constitution explicitly provides that any acts done in his/her capacity as President BEFORE the date of the Supreme Court's order declaring the election void are NOT invalidated. This is a constitutional safeguard for governance continuity. (2) Presidential election can be postponed if some Legislative Assemblies dissolved: WRONG. Article 62 makes Presidential election COMPULSORY before the term expires. Article 71(4) further provides that elections cannot be challenged on grounds that the electoral college was incomplete due to dissolutions. Practical experience: 1974 (after Allahabad HC verdict on PM), 2017 etc., elections proceeded. (3) Constitution prescribes time limits for President's assent to Bills: WRONG. Article 111 grants the President discretion in giving assent, withholding assent, or returning Bills for reconsideration with NO PRESCRIBED TIMELINE. This 'pocket veto' loophole was famously used by President Zail Singh in 1986. Source: Articles 62, 71, 111 of Constitution / NCERT Class 11 Indian Constitution at Work Ch 4.
