Section 12(1) of the Limitation Act, 1963 deals with computation of period of limitation for a suit, appeal or application. What is the rule on the day from which the period is reckoned?
Answer & Solution
Correct answer: C.
1. Section 12(1) of the Limitation Act, 1963 provides: 'the day which is to be excluded in computing period of limitation is the day from which the period of limitation is to be reckoned.'
2. So **the period of limitation is to be computed exclusive of the day on which the time begins to run**.
3. Section 12(2) further provides exclusions for appeals and revisions — the day on which the judgement was pronounced and the **time requisite for obtaining a copy** of the decree, sentence or order appealed from shall be excluded.
4. Section 12(3) gives exclusion of time for obtaining a copy of the judgement for an application for leave to appeal; Section 12(4) gives the same for applications to set aside an award.
