The ICSI material lists two heads of defamation. Which of the following is the correct distinction between Libel and Slander?

Answer & Solution
Correct answer: A.
1. The ICSI text records: '**Libel** is a representation made in some **permanent form**, e.g. written words, pictures, caricatures, cinema films, effigy, statue and recorded words.' 2. '**Slander** is the publication of a defamatory statement **in a transient form**; statement of temporary nature such as spoken words, or gestures.' 3. 'Generally, the **punishment for libel is more severe than for slander**. Defamation is tort as well as a crime in India.' 4. In India both libel and slander are treated as a crime — **Section 499 IPC** recognises both as offences. Options B, C and D invert or invent distinctions. _Source: ICSI CS Executive — Lesson 6, '(g) Defamation', pp. 148-149._
