The tort of 'false imprisonment' consists in:

Answer & Solution
Correct answer: D.
1. The ICSI text says: '**False imprisonment consists in the imposition of a total restraint for some period, however short, upon the liberty of another, without sufficient lawful justification.**' 2. The restraint may be effected by **confinement within four walls** OR by **preventing a person from leaving the place where he is** — for instance, restraining a man by threat of force from leaving his own house or an open field is false imprisonment. 3. So option C is wrong because the restraint need not be in a building. 4. Option A is the tort of **malicious prosecution** (instigating judicial proceedings) and option D is also part of that tort. False imprisonment is a separate concept. _Source: ICSI CS Executive — Lesson 6, '(d) False Imprisonment', p. 147._
