Section 10 of the General Clauses Act covers acts or proceedings directed to be done in a Court or office on a certain day. If the Court or office is closed on the prescribed day, what is the effect?
Answer & Solution
Correct answer: B.
1. Section 10(1) provides that where any act or proceeding is directed or allowed to be done or taken in any Court or office on a certain day or within a prescribed period, and the Court or office is closed on that day or the last day of the prescribed period, **the act or proceeding shall be considered as done or taken in due time if it is done or taken on the next day afterwards on which the Court or office is open**.
2. The proviso excludes acts or proceedings to which the **Indian Limitation Act, 1877** (now 1963) applies — limitation has its own Section 4 for this purpose.
3. So missing the deadline because the Court was shut does NOT defeat the act; it rolls over to the next open day.
4. The rule protects litigants and applicants from holidays and unscheduled closures of registries.
